For the past 25 years, Congress and the courts have strengthened the rights of patent holders. But now there are widespread concerns that the law has gone too far in protecting those rights to the detriment of economic growth and innovation in the United States. As a result, the pendulum is starting to swing back. In its last three terms, the U.S. Supreme Court has issued rulings that cut back on the rights of patent holders and even the Court of Appeals for the Federal Circuit—once the champion of patent rights—has begun changing direction. Congress is working on legislation that would bring profound changes to patent law. This program will look at how patent law got to where it is today, how that pendulum is swinging back and what the ramifications will be for lawyers who concentrate on patent law as well as lawyers who advise businesses generally.
