Live Webcast: An Interview with the Head of Enforcement for the PCAOB
Presented by West Legalworks
WHEN
- April 3, 2008 1:00 PM - 2:00 PM
DESCRIPTION
The Public Company Accounting Oversight Board was created by the Sarbanes-Oxley Act to oversee the auditors of public companies in order to protect investors and further the public interest in the preparation of informative, fair, and independent audit reports. To date, the PCAOB has reported the resolution of 16 disciplinary proceedings, ranging in seriousness from the recently reported $1 million fine imposed on a Big 4 firm, to numerous revocations of registrations for smaller firms, and orders baring particular individuals from being an associated person with a registered public accounting firm, to censures of certain firms and individuals.
Lisa Wood, co-chair of Foley Hoag's Accounting Liability and Securities Litigation practice groups, will interview Claudius Modesti, Director of Enforcement and Investigations for the Public Company Accounting Oversight Board in a West Legalworks webinar on April 3rd.
Topics covered will include:
- An overview of the professional background and responsibilities of the entire enforcement staff at the PCAOB.
- Plans for further development of the Board’s enforcement division.
- How matters come to the attention of the enforcement staff at the PCAOB, including the importance of its whistleblower hotline, and its coordination with the SEC and other federal law enforcement agencies.
- Overview of the PCAOB’s rules of practice and how they differ from those of the SEC and Department of Justice. Mr. Modesti will discuss the Board’s rules with respect to document production, including e-discovery, and the conducting of investigative interviews and the taking of sworn testimony.
- The scope of the PCAOB’s statutory authority to regulate auditors under the Sarbanes-Oxley Act.
- The PCAOB’s expectations regarding the cooperation of registered firms and their clients in PCAOB enforcement matters, and what impact, if any, such matters have on the PCAOB’s exercise of its powers and its resolution of matters.
- Past enforcement matters pursued by the PCAOB, and how they were resolved.
- Past and future enforcement priorities of the enforcement staff of the PCAOB.
