DESCRIPTION

MassDEP recently issued draft stormwater regulations that are expected to affect property owners all over the Commonwealth including colleges, hospitals, office, multifamily, retail, and industrial users. The regulations, as currently written, will cost affected businesses a minimum of nearly half a million dollars and for large properties, potentially several millions of dollars.

Something as minor as the repair of roofs and parking lots would trigger compliance with the regulations and require expensive and costly retrofitting of stormwater infrastructure. Existing properties with impervious surfaces of 5 acres or greater (this includes the combined total amount of parking area, driveways, and roof area) will be affected. More stringent requirements will be applied to properties with 2 or more acres of impervious surfaces in the Charles River Watershed.
