Recent court decisions on the Massachusetts Payment of Wages statute call into question a practice of many early stage and small companies - the deferral of employees' salary until some financing or profitability targets are reached. At the same time, Massachusetts law significantly restricts the use of independent contractors in lieu of employees. As a result, many early stage companies struggle with balancing their legal obligations as employers with their financial means.
