Lawyer Publishes Book on Party Autonomy in International Litigation

Carlos Alberto Arrue Montenegro, an associate in Foley Hoag’s Paris office and a member of its International Litigation and Arbitration Practice, has published L’Autonomie de la volonté dans le conflit de juridictions (Party Autonomy in International Litigation) with French publishers Lextenso and LGDJ.
In the book, Arrue examines the importance and functions of party autonomy in international commercial litigation through a comparative law research that analyzes, under French and Panamanian Private International Law rules and other legal traditions, dispute settlement agreements, and waivers on jurisdiction, procedure and recognition of foreign judgments and awards. The book also offers lawyers, law professors and law students a wide range of legal arguments to resolve the complex issues that appear in international litigation before state courts or arbitral tribunals in practice.
In 2010, Arrue’s dissertation on the topic was awarded the Berthold Goldman Prize and the Prize of the Scientific Counsel of Panthéon-Assas (Paris II) University. It is currently nominated for the Levy-Ullmann and Robert Dennery Prizes from the Chancellerie des Universités de Paris.
