Representative Experience

Representing the Massachusetts Bay Transportation Authority (MBTA) in a design-build procurement for the reconstruction of the Greenbush Line Corridor of the Old Colony Commuter Rail Line, the first rail design-build project in New England. As counsel for our client, we developed the procurement, prepared all contract documents, and facilitated the procurement with the MBTA and its engineering and permitting team. We continue to be involved in the closeout phase of this project.

Representing the Massachusetts Highway Department and Turnpike Authority in matters related to the creation of the Metropolitan Highway System. The work includes the initial environmental permitting, land acquisition and relocation, litigation, and the agreement to transfer completed segments of this project.

Devised and implemented model telecom regulation in Boston, which allowed national carriers to gain the necessary access and approvals to build fiber optic networks

Represented MassHighway in the successful development of the first design-build-finance transportation project in New England—the Route 3 North Transportation Improvement Project. A single design-build contractor designed and constructed the $384 million expansion of the 21- mile long, limited-access highway north of Boston. Acting as counsel for MassHighway, Foley Hoag developed the procurement process, drafted the contract documents and provided advice in the selection and final negotiation with the contractor team. We continue to be involved in the wrap-up phase of this project.

Representing the Malden Redevelopment Authority, as lead project counsel to the Mystic Valley Development Commission. The commission is involved in the development of the TeleCom City Project, a 200-plus acre redevelopment undertaken by the Massachusetts cities of Malden, Medford and Everett. The work includes drafting special legislation, drafting and negotiating land disposition agreements, assisting in the acquisition of land by negotiated purchase and by eminent domain, and numerous other responsibilities related to this important regional project.
