We were retained by a large corporation to assist in efforts to settle, through mediation, a complex antitrust and patent infringement litigation pending in North Carolina. Although the corporation had litigation counsel, we were separately retained to analyze settlement strategies and participate in a mediation between senior business executives. The matter was successfully resolved.

Successful High-stakes Patent Defense

Our lawyers were victorious as counsel to Johns Hopkins University, Baxter Healthcare Corporation, and Becton Dickinson and Company in a closely watched biotechnology patent litigation against CellPro, Inc., enabling our clients to successfully enforce monoclonal antibody and stem cell technology patents

Resolving Conflicts, Saving Time and Money

Our lawyers assisted a major manufacturer of diagnostic medical equipment in resolving a costly and time-consuming antitrust and patent infringement litigation. Working with the company’s in-house lawyers and key business executives, we analyzed the merits of the claims, the amount of potential damages and the business objectives the client hoped to achieve. After two days of mediation, the matter was satisfactorily resolved, at minimal additional expense.

KVH Industries

Our lawyers recently secured a key patent win for longtime client KVH Industries, a Rhode Island-based provider of in-motion satellite television and communication systems, in addition to navigation and guidance products. A jury in the U.S. District Court in Minnesota returned a verdict in favor of KVH that the company was not liable for infringing King Controls' U.S. Patent 6,864,846 involving satellite switching technology because the asserted claim of the patent was invalid over prior art presented by KVH at trial. The win clears the way for KVH to continue sales of its leading TracVision® line of in-motion satellite television products used around the world on boats, automobiles, recreational vehicles, trucks and buses.

QLT

We represented QLT in complex patent and trade secret litigation arising out of a collaboration among QLT, Massachusetts Eye and Ear Infirmary, and Massachusetts General Hospital that led to the development of photodynamic therapeutic treatment for age-related macular degeneration. We obtained a district court order correcting inventorship to add QLT’s scientist to the patent, leading to a stipulated dismissal.

Harvard University and Massachusetts Institute of Technology

Our lawyers have been retained by Harvard University and Massachusetts Institute of Technology in several projects, and have obtained worldwide patent protection for numerous pioneering inventions in organic chemistry and chemical engineering. For example, we have obtained for the institutions domestic and foreign patents protecting asymmetric transition-metal-catalyzed reductions; asymmetric transition-metal-catalyzed cycloadditions; and transition-metal-catalyzed carbon-heteroatom and carbon-carbon bond-forming reactions.
