Enforcing Famous Trademarks in the Footwear Industry
We have represented Converse, Inc. in number of trademark infringement matters, including disputes with Stride Ride Corporation and with Reebok International, Ltd. For example, we represented Converse when Converse sued Reebok for infringement of Converse’s famous ALL STAR mark. The dispute was resolved with a settlement that included Reebok’s agreement to refrain from future use of the ALL STAR mark. In addition, we represented Converse in a trademark infringement action brought against Stride Rite over Stride Rite’s sale of shoes bearing a mark similar to Converse’s TOE SMILE trademark, which was settled on terms favorable to Converse.

Protecting Our Client's Confidential Information on the Internet
We assisted our client, the maker of medical devices, in stopping leaks of secret clinical trial information on Internet message boards. Our client was faced with a situation where unknown third parties were publishing information relating to the company’s clinical trials before the information had been released by the company. By filing a John Doe action, issuing a number of subpoenas to Internet service providers and message board operators, and conducting additional investigative work, we were able to determine the identity of the persons leaking the information and depose them. This allowed us to force quick settlements and to successfully prevent any further postings by the offenders.

Helping a Biotech Company Preserve its Trade Secrets
We helped a leading biotechnology company prevent a key executive who held competitive intelligence from defecting to a competitor in a situation that entailed a high risk of leakage of trade secrets. The executive had participated in confidential strategy sessions to discuss how certain proposed products would fare if marketed in competition with the products of a particular competitor. Shortly afterwards, the executive resigned and began working for the competitor. We conducted forensic analysis of the departed executive’s computer and were able to show that the executive had been involved in improper downloading of our client’s trade secret material. We formulated a legal strategy that caused the competitor company to terminate our client’s former executive immediately.

Enforcing Trade Secrets in the Financial Services Industry
We acted for an investment management company that faced a theft of trade secrets by former employees who were trying to start a rival firm. Our client discovered that two senior employees were leaving in order to start their own competing firm. Upon investigation, our client learned that the former employees had removed not just information but entire computers containing trade secret information when they left the firm. We were able to recover some computer technology from the departed employees and conduct forensic analysis on it. This allowed us to obtain significant evidence of theft of trade secrets, breach of employee agreements, and other wrongs by the departed employees. As a result of these efforts, we reached a quick and highly advantageous settlement of the dispute on behalf of our client.
