Defending Allegations of Illegal Kickbacks

Our lawyers successfully defended an individual who was the target of a federal grand jury investigation on allegations that he and his company paid illegal kickbacks to physicians to encourage the purchase of kidney dialysis supplies. We successfully prevented charges from being brought against him.

Disclosing Medicare Over-billing

On behalf of our client, we made the first voluntary disclosure of Medicare over-billing in New England under the Office of Inspector General’s voluntary disclosure protocol. Our lawyers negotiated the related settlement agreement, as well as an innovative corporate integrity agreement. As a result, we avoided lengthy litigation that might have led to our client being barred from participation in the Medicare program.

Leading Counsel to Issuers in Public Offerings

Our lawyers are leaders in representing issuers in public offerings, including a recent notable transaction involving a $100 million-plus initial public offering for a healthcare software company following its leveraged recapitalization.

Major Legislative Milestones

Our lawyers worked on key pieces of health legislation while working as congressional staff members. These include the Medicare Prescription Drug, Improvement and Modernization Act of 2003 (MMA), the 1997 Food and Drug Administration reform law, the Orphan Drug Act, and the Health Insurance Portability and Accountability Act of 1996, and the Public, Health, Security and Bioterrorism Preparedness and Response Act. We have also worked on legislation involving specific changes to Medicare and Medicaid law. Today, our lawyers represent several leading pharmaceutical and biotechnology companies and industry trade associations in their implementation of and ongoing preparedness for these laws.
