Foley Hoag Congratulates GenOn Kendall, LLC on Receiving Prestigious Regional EPA Environmental Award

Foley Hoag LLP congratulates its client GenOn Kendall, LLC for receiving an Environmental Merit Award from the U.S. Environment Protection Agency for its role in helping to protect the waters of the lower Charles River and Boston Harbor.
Foley Hoag represented GenOn Kendall, LLC in the settlement of the Kendall Station National Pollutant Discharge Elimination System appeal. The permit for the Kendall Cogeneration Plant will allow the facility to continue operating economically and result in a 95 percent reduction in heat discharge and cooling water withdrawals from the plant. It will also result in large institutional customers in Boston being able to access a new supply of steam for heating and cooling their buildings.
The other parties to the settlement, including the Massachusetts Department of Environmental Protection, the Conservation Law Foundation and the Charles River Watershed Association, also received an Environmental Merit Award during the ceremony Thursday at Faneuil Hall in Boston. GenOn Kendall, LLC was one of 19 Massachusetts businesses, environmental groups, individuals, nonprofits and government agencies honored for making contributions to environmental awareness and problem solving.
“These parties being recognized have helped ensure that the river will be a treasured recreational and ecological resource for future generations,” according to the EPA.
Foley Hoag partners Mary Beth Gentleman and Seth Jaffe represented GenOn Kendall, LLC in the settlement, which was the result of more than two years of work.
