Client Physicians of Cape Cod ACO Selected as One of 27 ACOs Nationally to Participate in Medicare Shared Saving Program

April 11, 2012

Foley Hoag LLP client Physicians of Cape Cod ACO was one of 27 accountable care organizations nationwide selected by the Centers for Medicare & Medicaid Services for participation in the Medicare Shared Saving Program, an initiative of the Patient Protection and Affordable Care Act.

Under the Medicare Shared Saving Program, ACOs agree to be held accountable for improving the health and experience of care for individuals and improving the health of populations while reducing the rate of growth in healthcare spending. ACOs will have the opportunity to share in savings realized through improved care, according to CMS.

Lawyers from Foley Hoag’s Healthcare Practice helped establish the new entity that will serve as the ACO, which is based in Hyannis, Mass. Foley Hoag partner Colin Zick and associate Michelle Limaj advised Physicians of Cape Cod.

Foley Hoag’s integrated team of healthcare lawyers have experience in a wide range of government strategies, compliance and government investigations, litigation, and corporate transactions. They help clients find creative approaches to their business challenges and help strategically position them for success in the highly competitive healthcare marketplace.

Physicians of Cape Cod has been coordinating care for beneficiaries through a managed care program for 10 years. The organization intends to bring the experience developed in that program to the new ACO model for fee-for-service beneficiaries. It is expected to serve nearly 5,000 beneficiaries living on Cape Cod.
