Foley Hoag Attorneys Kenneth Figueroa and Alexandra Kerr Meise to Present at International Bar Association Mining in Africa Conference

Foley Hoag LLP partner Kenneth Figueroa and associate Alexandra Kerr Meise, both of the firm’s International Litigation and Arbitration practice, will be panelists at the International Bar Association’s conference titled, “Mining in Africa: Opportunities and Legal Challenges,” being held September 8-9, 2014 at The Julius Nyerere International Convention Centre in Dar es Salaam, Tanzania.

This event will focus on international best practices for the mining industry, the African Union’s mining vision and action plans for Africa, human rights issues, and responsible contracting. A comparative review of trends in mining law and regulation; acquisition and maintenance of mining rights; and the environmental aspects of natural resources and energy investments in Africa will also be covered.

Figueroa’s panel, titled “Stabilization Agreements and Legislation,” will address the rationale for the use of stabilization clauses with other investor protections such as bilateral investment treaties. The session will also explore the enforceability of these clauses and evaluate how stabilization legislation and agreements affect potential mining investments. Figueroa’s remarks will focus on international tribunals’ enforcement of stabilization clauses and related issues concerning State sovereignty.

Meise will speak on “Communities, Human Rights and Free, Prior, Informed Consent,” addressing the increasing importance of corporate social responsibility in the resources industries in Africa. Meise’s remarks will focus on avenues of international liability for governments and multi-national corporations arising out of their extractive-sector activities, as well as the application of the Voluntary Principles on Security and Human Rights.
