Foley Hoag Attorneys Alexandra Kerr Meise and Constantinos Salonidis to Speak at Investment Arbitration Training Program at Columbia University

Foley Hoag LLP associates Alexandra Kerr Meise and Constantinos Salonidis, both of the firm’s International Litigation and Arbitration practice, will serve as faculty members at the CCSI Executive Training Program on Investment Arbitration for Government Officials, being held July 13-17, 2015 at Columbia University in New York.
This intensive week-long course, aimed at government officials involved in investor-state arbitration who manage investment treaty disputes and/or negotiate investment treaties, will focus on crucial procedural and substantive aspects of investment law. Scheduled topics of discussion include new developments in challenges to jurisdiction; process of and strategies for arbitrator selection and challenges; the relationship between contract-based and treaty-based claims; strategies for deterring or securing dismissal of frivolous claims; and new trends in treaty practice.
Salonidis' session, “Jurisdiction: Making Preliminary Objections to Jurisdiction and Admissibility, Seeking Bifurcation,” will examine objections to tribunals’ jurisdiction ratione temporis and ratione voluntatis and to the admissibility of claims as well as rationales and strategies for raising jurisdictional and admissibility objections as preliminary matters in order to seek prompt dismissal of claims, taking into account arbitral rules and treaty language that may require or facilitate such strategies.
Meise will speak on “Expropriation: Elements, Defenses and New Developments,” addressing the fundamentals of expropriation claims in the investor-State context, and potential avenues of liability for expropriation under international law. In addition, Meise will review strategies for structuring one's defense and how that might affect damages mitigation measures and valuation calculations.
