Dr. Carlos Arrue Montenegro, an associate, focuses on international litigation, especially on dispute settlement agreements (arbitration and choice of court agreements), State contracts, expropriations and conflicts of laws. He has represented and advised Panamanian institutions such as the Panama Canal Authority and the Ministry of Public Works in State proceedings and international arbitration, and has assisted with all aspects of investment arbitration cases before the ICSID and the ICC.

Representative Experience

Investment Arbitration

  • Represented Ecuador and PetroEcuador in an ICSID arbitration regarding an alleged expropriation of a petroleum multinational consortium due to tax modifications. Repsol YPF Ecuador, S.A. et al v. The Republic of Ecuador and PetroEcuador.
  • Represents Venezuela in an ICSID arbitration regarding the alleged expropriation of gold and diamond mining concessions in Venezuela. Highbury International AVV and Ramstein Trading Inc. v. Bolivarian Republic of Venezuela.
  • Represents Ecuador in an UNCITRAL arbitration regarding an alleged denial of justice case concerning proceedings before the Ecuadorian Courts in a case between farmaceutical companies.

International Commercial Arbitrations

  • Represents two Tunisian companies in an ICC arbitration in London concerning the distribution in Tunisia of materials used for the exploitation of oil.
  • Represented an important French electricity company against an Italian company in an ICC arbitration in Switzerland.
  • Representing a France-domiciled recycling company set up by several leading producers of electrical and electronic equipment in an ICC arbitration against a French international logistics service provider.
  • Intervened as a consultant in favor of a Panamanian public law entity, in an international arbitration concerning the breach of contractual obligations by a broker based in England.

Professional Experience

  • Professor of Droit du Commerce International, Université Paris XIII, Paris, 2012-2013.
  • Previously was an Assistant Professor and Researcher in Private International Law and in International Trade Law at the Université Panthéon-Assas (Paris II), and a Professor of International Litigation and Comparative Law at the Universidad Latina de Panama.
  • Served as a legal advisor and attorney for Panamanian institutions such as the Minister of Public Works (State expropriation matters, contract claims against other State institutions) and the Ministry for the Ministry of Youth, Women, Childhood and Family.
