Eric Haskell focuses his litigation practice on complex commercial litigation and arbitration, consumer class action defense, and products liability defense. He represents clients in state and federal courts in New England and across the United States.

Eric has significant experience representing and advising retailers, manufacturers, pharmaceutical firms, and medical device firms with respect to enforcement of arbitration clauses, unfair/deceptive consumer practices laws, contract disputes, business torts, product liability, and electronically stored information (“ESI”) and e-Discovery issues.

Representative Experience

  • Obtained dismissal of consumer class action in Massachusetts state court following successful appeal to Supreme Judicial Court regarding enforcement of arbitration agreement in customer terms and conditions.
  • Obtained summary judgment in Rhode Island Superior Court against consumer class action alleging bad faith collection of sales tax.
  • Successfully represented medical device firm in connection with breach of contract and theft of trade secrets claims.
  • Defended pharmaceutical company in products liability matter and negotiated favorable settlement of claims.
  • Prosecuted sales tax abatement claims on behalf of retailers in Massachusetts Appellate Tax Board.
  • Represented insured in coverage and bad faith claims regarding defense and indemnity of long-tail claims.
  • Successfully defended plumbing equipment manufacturer in numerous related product liability matters.
  • Represented manufacturer in connection with environmental contamination claims.
  • Represented defendant in capital murder prosecution.
  • Successfully defended numerous legal services organizations against subpoenas by criminal defendants seeking to obtain privileged records between the legal services organizations and their clients.
  • Submitted amicus brief to Massachusetts Supreme Judicial Court arguing that procedure for criminal defendant to review privileged records of alleged victim for exculpatory evidence does not apply to attorney-client privileged records.
  • Successfully defended Cambodian green-card holder against deportation proceeding.
