Anna Toubiana is an International Associate in the firm’s Washington, D.C. office and a member of the International Litigation and Arbitration Practice Group. Her practice focuses on Sovereign State Representation; primarily on Investor-State disputes. Anna has experience working with the International Chamber of Commerce (ICC), International Center for Settlement of Investment Disputes (ICSID) and United Nations Commission on International Trade Law (UNCITRAL) rules.

Representative Experience

  • Metro de Lima Línea 2 S.A. v. Republic of Peru. Representing Peru in a ICSID case derived from a Public-Private Partnership contract for the construction of one of the phases of the Lima metro.
  • Democratic Republic of Congo v. Republic of Uganda. Member of the team representing Uganda before the International Court of Justice in the reparations phase related to the damages resulting from the armed activities carried out in the territory of the DRC.
  • Crystallex International Corporation v. Bolivarian Republic of Venezuela (ICSID Case No. ARB(AF)/11/2). Represents the Bolivarian Republic of Venezuela before the United States District Court for the District of Washington, D.C. in the proceedings to vacate the arbitral award rendered in the arbitration brought before ICSID (Additional Facility) by a Canadian company under a bilateral investment treaty in connection with a mining operating contract.
  • Louis Dreyfus Armateurs SAS v. Republic of India. Representing India in a UNCITRAL Arbitration under the France-India bilateral investment treaty arising from a contract concerning the supply and operation of cargo handling equipment.
  • TENARIS S.A. and TALTA – Trading e Marketing Sociedade Unipessoal Lda. v. Bolivarian Republic of Venezuela (ICSID Case No. ARB/12/23). Representing the Bolivarian Republic of Venezuela in an ICSID proceeding brought under bilateral investment treaties in connection with the steel industry.
  • Gold Reserve, Inc. v. Bolivarian Republic of Venezuela (ICSID Case No. ARB(AF)/11/1). Representing the Bolivarian Republic of Venezuela in an ICSID (Additional Facility) proceeding brought by a Canadian company under a bilateral investment treaty in connection with a gold mining concession. Representing the Republic in subsequent proceedings to vacate the arbitral award before courts in Paris, France and to challenge enforcement proceedings in Luxembourg, London and Washington, D.C.
  • Anglo American Plc v. Bolivarian Republic of Venezuela (ICSID Case No. ARB(AF)/14/1). Representing the Bolivarian Republic of Venezuela in an ICSID (Additional Facility) proceeding brought by a major United Kingdom-based mining company under a bilateral investment treaty in connection with a nickel mining concession.
  • Merck Sharpe & Dohme (I.A.) v. The Republic of Ecuador. Representing the Republic of Ecuador in an UNCITRAL arbitration under the Ecuador-U.S. bilateral investment treaty arising from the alleged treatment of a foreign investor by the Ecuadorean judiciary.
  • Pac Rim Cayman v. Republic of El Salvador (ICSID Case No. ARB/09/12). Representing El Salvador in an ICSID arbitration brought under the Salvadoran Investment Law in relation to a gold mining project.
