Foley Hoag LLP secured a critical victory for the government of Bolivia when a federal judge held that foreign investors in a recently nationalized company had improperly attached the company’s U.S. assets, and issued an order dissolving the attachment. The decision could have major implications in other state-investor disputes in Latin America and elsewhere tied to nationalization of corporate assets.

Global Bio-Chem Technology Group Company Limited and its affiliates (GBT), the largest lysine producer in China and the largest vertically integrated corn-based biochemical manufacturer in Asia, has prevailed after an evidentiary hearing before the United States International Trade Commission (USITC) in a patent infringement investigation brought by Ajinomoto Heartland LLC and Ajinomoto Co., Inc. (Ajinomoto). In today’s ruling, the Administrative Law Judge (ALJ) held that the claims of Ajinomoto’s two patents were invalid for failure to disclose the best mode of practicing the invention, thus finding no violation of Section 337 of the Tariff Act of 1930. The ALJ also ruled that both patents were unenforceable because Ajinomoto had committed inequitable conduct. In an unprecedented case in which a pair of Venezuelan mining companies sought more than $200 million from the Venezuelan government in compensation for giving up their concessions to a dam project, a federal judge in the Southern District of New York has dismissed the plaintiffs’ suit, citing lack of jurisdiction – as well as evidence that an apparent agreement between the parties to transfer jurisdiction to the United States was fraudulent.

The Republic of Ecuador has filed suit at the International Court of Justice in The Hague, the Netherlands, against the government of Colombia, in an effort to stop or restrict aerial anti-coca spraying that has allegedly sickened people on the Ecuadorean side of the border and harmed livestock, farmland, and sensitive, ecologically diverse jungle areas.
