Litigation Technology Services
Vast—it’s the only word to describe the volume of records and data you or your organization possesses. Did you know that all of it could be subject to discovery during a lawsuit?
As technology advances, paper records, once the primary source of documentation, are becoming increasingly less essential. Now, more than likely, your organization’s vital information exists electronically on an array of media, including network drives, personal hard drives, USB storage devices, phones and other devices. Unfortunately, these documents are not immune from the legal process. The fact is electronic documents have always been discoverable. Technical advances and recent changes to the rules that govern litigation matters have simply made us focus more on electronic records.
While document repositories have grown exponentially, the portion of material you’ll typically need to produce during a court case remains relatively small. Consequently, document and records management is critical. In today’s technology-dominated world, cost-effective, proficient litigation requires three things:
- Access to all types of records from widely diverse sources
- Efficient organization of these documents
- Control over their dissemination
Does your current law firm understand the data map of your servers? Are they capable of accessing and organizing your diverse records and documents, while maintaining complete control over your data - and doing this with the least possible interruption to your daily business operations? Can the firm’s lawyers tap the capabilities of the latest technologies to meet your needs and efficiently fulfill your objectives? Foley Hoag stays up-to-date on the latest technological developments and works to use these advancements to optimize our ability to manage your legal matters.
Sophisticated Technology for Document Management and Case Organization
At Foley Hoag, we support both Summation and Concordance. Both are sophisticated case management software programs designed to bring greater efficiency to your case preparation by creating one consolidated database for searching, reviewing and annotating documents. Additionally, these programs provide customized report options for fact review; deposition preparation; and trial preparation, including witness kits, privilege logs, annotations, and production history reports.
Electronic Discovery
Foley Hoag recognizes the complexity of electronic discovery, and we are equipped to process electronically formatted data. We stay current on the latest industry practices and counsel our clients accordingly. For example, we understand that cost-effective e-discovery requires extensive culling, with the caveat that it be accomplished in both a rational and defensible manner within the scope of the new FRCP Rule 26.
Transcript Management
We use specialized transcript management software to organize the transcripts associated with your litigation matters. Both Summation and LiveNote can search and retrieve testimony and exhibits for speedy and efficient reviews of depositions and trial preparations, or for preparing pleadings, such as deposition designations.
Trial Presentation Tools
“A picture is worth a thousand words,” as they say, and we use this maxim to your advantage. We extensively use trial presentation software, including Sanction and Trial Director, to communicate evidence at trials, hearings or arbitrations. These programs allow us to digitize relevant material and then visually present evidence that is more comprehensible to judges or juries. In all types of litigation matters, the advantages gained from this approach are always substantial.
Translation Services
Do your litigation matters span the globe? Many of our cases involve the production or receipt of documents and electronic data files in foreign languages. We can help in developing the best way to triage, translate and review documents in over 100 languages. We also advise and assist with the hiring of translators and check translators or depositions or trial.
Best Practices
At Foley Hoag, we understand that even the most sophisticated technology can be ineffective if it is applied inconsistently. That’s why we developed pre-defined standards, procedures, methodologies, logs and forms for all tasks associated with handling your discovery materials, both paper and electronic. This consistency improves our ability to efficiency handle these tasks—reaffirming our commitment to providing you with high quality, cost-effective representation.
Training and Support
The successful tactical planning of your litigation matters requires proper, ongoing training in the latest technological advances. To maximize service to our clients and ensure that our litigation technology is optimally used, our lawyers and paralegals regularly receive instruction and support for all of our litigation software programs.
