Partner and Registered Patent Attorney Allison Gilder will speak on the panel “The Strategic Applicant: Prosecuting Life Sciences Patents for What Comes Next,” at IPWatchdog’s Life Sciences Masters™ 2026. When a life sciences patent application is filed, no one knows exactly what the future holds. The invention may ultimately support a blockbuster product, become central to a collaboration or licensing transaction, increase the value of an acquisition target, provide negotiating leverage, or become the patent at the center of high-stakes litigation years later. Strategic prosecution therefore requires more than obtaining an allowance; it requires preserving options for whatever comes next.

This panel will examine how sophisticated applicants prosecute life sciences patents with that uncertain future in mind. Panelists will discuss building applications and claim sets with flexibility, managing continuation strategies, using examiner interviews effectively, navigating restrictions, RCEs, appeals and supervisory involvement, and deciding when faster prosecution makes strategic sense. The panel will also explore how choices made during prosecution can preserve, or unnecessarily surrender, future claim scope, transaction value and enforcement positions. The objective is not simply to obtain patents, but to build durable portfolios capable of supporting opportunities and surviving challenges that cannot be fully anticipated when prosecution begins.
