Partner Sarah Burg was quoted in Law360's midyear report, "Biggest Rulings For Patent Attys In 2026," providing insight on two significant developments shaping patent litigation and Federal Circuit practice.
Burg commented on the Federal Circuit's decision in A.L.M. Holding Co. v. Zydex Industries Private Ltd., which clarified standing requirements in patent infringement cases involving licensed patents. Burg noted that the court's standing precedent "has not always been clear," adding that district courts have been "somewhat all over the map about how to treat license agreements and how many rights are retained or not."
Highlighting the ruling's practical value, Burg said, "The license agreements cases and the standing issues are always going to be fact specific and somewhat case by case, but it is nice to actually see a more extensive discussion and analysis from the court that is more usable and applicable than a lot of decisions we've seen in the past."
Burg also commented on the U.S. Supreme Court's decision not to hear suspended Federal Circuit Judge Pauline Newman's challenge to the judicial disciplinary process, noting, "She's obviously a very distinguished jurist with a long career, and it's been just an unfortunate situation all around. I think it ends with the cert denial."
