Law360 named the Foley Hoag team representing Power Forward Communities a Legal Lion of the week after the D.C. Circuit granted a petition for en banc review of a three-judge panel’s prior decision that would have overturned a federal district court's injunction blocking the U.S. Environmental Protection Agency from dismantling a $14 billion program mandated by Congress for clean-energy investments in communities across the United States.
In 2024, Power Forward Communities, a coalition of leading affordable housing, climate, and community investment groups, was awarded a $2 billion grant through the Greenhouse Gas Reduction Fund to fund clean-energy affordable housing and renovation projects. In March, the EPA moved to terminate the grants and eliminate the program, and a Foley Hoag team – along with legal teams representing the other affected organizations – moved quickly to secure a preliminary injunction in federal district court. Following last week’s D.C. Circuit ruling, that injunction remains in place.
