Compliance Lessons From Agriculture Co. Mexican Bribe DPA

Adam Safwat, partner and co-chair of the firm’s White Collar Crime & Government Investigations Group, recently wrote the article “Compliance Lessons From Agriculture Co. Mexican Bribe DPA” in Law360. 

The article examines how the U.S. Department of Justice’s (DOJ) shift in focus under the Foreign Corrupt Practices Act (FCPA) to cases involving U.S. national security provides context to the recent deferred prosecution agreement between the DOJ and the Scoular Company, a Nebraska-based agricultural supply chain company caught making bribe payments to Mexican officials through a third-party customs broker, and how some proceeds went to a cartel. It also highlights the need for certain enhancements in compliance policies for companies engaging in cross-border trade with Mexico.
