Alison Bauer Comments on Bankruptcy Trends in 2026

Alison Bauer, co-chair of Foley Hoag’s Bankruptcy & Restructuring practice, commented on bankruptcy trends to watch for in 2026 in the Bloomberg Law article “Bankruptcy in 2026 to Be Guided by Policy Change, Fraud Scrutiny.”

Bauer indicated that the intoxicating hemp industry could see a rise in insolvencies in 2026 as a result of the ban on commercial sale of those products in July 2025, and highlighted President Trump’s executive order to reschedule cannabis as another potential catalyst for federal bankruptcy court restructurings under certain conditions.

Bauer also predicted that the renewable energy sector would likely see an increase in restructurings in 2026. “The expiration of the clean energy tax credits has created a lot of distress,” noting a string of high-profile renewable energy bankruptcies in 2025.
