Massachusetts Legislature Finalizes Permit Extension Language – Get those permits now!
Blog November 15, 2024
In some good news for the development community, the Massachusetts legislature has finalized language that would extend the validity of most municipal and state permits related to land development or the environment for a period of two years…
New Report Details Massachusetts Whole-of-Government Approach to Climate Crisis
Blog October 26, 2023
Yesterday, Massachusetts Climate Chief Melissa Hoffer issued a report detailing how “to implement the Healey-Driscoll Administration's whole-of-government approach to addressing the climate crisis.” The report identifies trends, barriers, and gaps in Massachusetts climate policy, establishes guiding principles for whole-of-government climate action, and offers recommendations to strengthen the “climate-related practices and policies of executive department agencies.” The recommendations……
New MEPA Rules Mean Big Changes For Practitioners and Developers
Blog December 22, 2021
In compliance with the Climate Roadmap Act, the Massachusetts Environmental Policy Act (MEPA) Office has released the final version of its new regulations and two final protocols regarding new MEPA review procedures to evaluate project impacts on Environmental Justice (EJ) populations.  The regulations will go into effect on December 24, 2021 and the two protocols will go into effect on January 1, 2022. Here are the big takeaways: The MEPA Regulations The new MEPA regulations include six……
Environmental Impact Review and Environmental Justice: How Hard Will It Be To Merge the Two?
Blog September 23, 2021
Environmental justice is clearly an idea whose time has – finally – come.  The need to find the intersection between the search for racial justice and efforts to save the planet is undeniable.  If we get it right, we'll be at least partially solving two problems at once.  First, mobilizing underserved communities in the fight against climate change and other environmental problems increases the number of voices arguing for aggressive action…
Massachusetts Climate Legislation Becomes Law - The Future of Everything
Blog March 29, 2021
It's not always the case, but my speculation about the Massachusetts climate bill was correct.  On Friday, Governor Baker signed it into law.  If I haven't succeeded in making this clear previously, I want to emphasize that this is a really far-reaching piece of legislation.  It commits Massachusetts to a very aggressive timetable for reducing GHG emissions.  It species a number of specific policies…
The Massachusetts Climate Bill is Very Much "Not Dead"
Blog March 22, 2021
In January, when Governor Baker vetoed the Legislature's effort to go big on climate, my colleague Zach Gerson made clear that the bill was not even “mostly dead.”  I am pleased to say that Zach's diagnosis was correct.  The climate bill is very much alive. Last week, the Legislature passed a new version of the bill, which adopted most of the Governor's technical suggestions and almost none of his substantive changes…
Massachusetts Starts 2021 With a Bang on Climate
Blog January 04, 2021
Over the past four years, while the Trump Administration did everything possible to ignore climate change, optimists continued to find progress at the state level.  And while President-elect Biden has put together an A-team on climate, Massachusetts, at least, seems determined to show that the states will continue to lead – even if they now have a partner at the federal level. Two weeks ago…
Massachusetts Climate Adaptation Policy: How Broad Will It Be?
Blog November 18, 2014
Yesterday, I suggested that Massachusetts EOEEA may not have authority to issue its “MEPA Climate Change Adaptation and Resiliency Policy.”  However, since I also conceded that Massachusetts courts are unlikely to agree with me, it's probably worth taking a look at what the Adaptation Policy would require.  As with any MEPA (or NEPA) analysis, it has two parts:  identification of impacts and discussion of mitigation measures…
Environmental Impact Analysis The Impact of a Project on the Environment or the Impact of the Environment on a Project?
Blog November 17, 2014
Traditionally, environmental impact analysis, under NEPA and state analogs, has focused on the impacts that a proposed project may have on the environment.  In Massachusetts, the Executive Office of Energy and Environmental Affairs has proposed a draft MEPA Climate Change Adaptation and Resiliency Policy.  The policy seems sufficiently important to warrant more than one post.  Today, I'll look at EOEEA's authority to promulgate an Adaptation Policy.  Tomorrow…

ABOUT

In today’s fast changing world, almost all of us get our news – including our news about developments in environmental law and policy – electronically. This blog is not intended to be a substitute for the BNA™, or Greenwire™, or Google™, although we do hope that we will be able on occasion to let you know about issues that haven’t yet come to your attention.

What we really want to accomplish is to be able to provide some perspective on those developments. We’ll try to tell you which developments may matter to you. And why they matter. And how they matter. Whether you are a manufacturer or a power plant developer, whether you are a renewable energy developer or hoping to be a renewable energy consumer, whether you are a municipality or public agency or university, we want to comment on current issues in a way that is useful to you in your business.

As the headline indicates, we want to inform, update, comment, and discuss. In other words, while we’re going to enjoy posting, we’ll enjoy the blog more – and its usefulness will increase – if we hear from you also. Please comment on the blog entries. Let us know about developments we missed or implications of our discussions that we did not consider.

We look forward to the conversation.
