Foley Hoag Secures Permanent Injunctions in Federal Court on Behalf of Timeline

A Foley Hoag team secured an important victory on behalf of client Timeline and its parent Amazentis, when the U.S. District Court for the District of Massachusetts granted the companies’ motion for default judgments and permanent injunctions against 19 online sellers found to have marketed and sold nutritional supplements falsely advertised as containing Urolithin A.

Independent laboratory testing confirmed that products sold under these brands, many purchased by consumers seeking clinically validated cellular health benefits, either contained no detectable Urolithin A or contained Urolithin A at only a fraction of what was advertised. Certain defendants also used Timeline’s Mitopure® trademark without authorization to promote the falsely labeled products.

The permanent injunction bars the 19 defendants and those acting in concert with them from continuing to import, market, advertise, distribute, offer for sale, or sell any product represented as containing Urolithin A. In addition, the Court has ordered the 19 defendants to pay damages to Timeline ranging from $500 to more than $2.7 million per defendant, reflecting the scope of each defendant's sale of fraudulent products. The awards against nine of the defendants were tripled as enhanced damages.  

The case is Amazentis SA and Timeline Longevity, Inc. v. The Partnerships and Unincorporated Associations Identified On The Schedule “A”, Civil Action No. 25-12913-MJJ (D. Mass), before Judge Myong J. Joun.  The Foley Hoag team representing Timeline includes Jeffrey I.D.
