Mital Patel

New York

I thrive on helping clients navigate their complex legal and business concerns, specifically in high-stakes IP and advertising disputes.

Mital Patel focuses her practice on patent litigation and advertising law matters. She has counseled clients across industries including pharmaceutical and technology companies, research institutions, and consumer product goods companies.

She has represented leading pharmaceutical, healthcare, and technology companies in a variety of venues, including in district court and at the Patent Trial and Appeal Board (PTAB). Her patent practice includes patent infringement actions including Hatch-Waxman litigation, inventorship and validity disputes, inter partes review proceedings, trade secret, and misappropriation actions. Her litigation experience spans pre-suit investigations, motion practice, discovery, and trial.

Mital’s advertising practice includes counseling and defending companies from false-advertising and deceptive practice allegations. She also has experience defending class action lawsuits and Lanham Act disputes. Mital’s advertising practice is primarily focused in the food, beverage, and consumer goods industry as well as the software space.

Mital also maintains an active pro bono practice and is committed to providing legal representation for those with limited access to legal services. She has worked with organizations such as the American Civil Liberties Union to advocate for victims of racist policing, Her Justice to represent victims of domestic abuse, and the South Asian Youth Action to mentor young students.

Mital is also a member of Foley Hoag’s Diversity Committee and Hiring Committee, as well as a co-chair of the Women Associates Group. Prior to her intellectual property practice, Mital represented major financial institutions in federal court litigation regarding structured products and derivatives.
