Our Sports & Entertainment Group represents organizations and individuals across all levels of sports and entertainment, from amateur organizations to professional leagues and emerging creatives to established talent and media companies. We provide practical, strategic counsel tailored to clients’ business objectives, advising on day-to-day operations, transactions, disputes, and regulatory matters, supported by a multidisciplinary team with experience in corporate law, intellectual property, employment, and litigation.

Within the sports industry, we counsel clubs, leagues, universities, and governing bodies on operational and strategic matters. We regularly draft and negotiate agreements and conduct internal investigations and represent athletes in endorsement matters.

We also represent talent, creatives, and media companies in a wide range of legal and business matters, including structuring and negotiating talent, production, distribution, recording, publishing, and sponsorship agreements.

Sports

  • Represented prominent NFL, NBA, MLB, NHL, WNBA, and PLL athletes in wide range of matters from general business to endorsements and sponsorships
  • Represented an NFL team in successfully dismissing claims of defamation and civil conspiracy
  • Represented a retired NFL star in launching an MMA league and streaming platform
  • Represented an NHL executive in securing a favorable outcome in a league investigation
  • Conducted an internal investigation and assisted a professional sports team in resolving claims of racial discrimination
  • Represented Fenway Sports Group in various matters, including land use, real estate, licensing, and permitting for ballpark expansions and other related matters
  • Represented Ubersense, a sports media company, in its acquisition by Hudl
  • Secured a victory for the American College of Veterinary Sports Medicine and Rehabilitation (ACVSMR) in the U.S. Court of Appeals for the Federal Circuit, affirming ACVSMR’s ownership of its trademark
  • Litigation counsel to several high-profile professional athletes in brand sponsorship and endorsement contract disputes
  • Brought a lawsuit on behalf of the world’s best women’s soccer players to challenge gender discrimination at the 2015 World Cup. Litigation helped achieve several player goals including increase in prize money, the use of goal line technology, a finding that FIFA could be subject to another nation’s courts, and a commitment by FIFA to play subsequent women’s World Cups on natural grass.
  • Represent Fenway Sports Group in various real estate, development and land use matters including its use of surrounding streets and matters related to the development of its nearby real estate
  • Represented the Worcester Redevelopment Authority in the land assembly, construction, and other matters concerning the relocation of the Pawtucket Red Sox to Worcester and the development of Polar Park
     

Entertainment

  • Represent a regulated exchange and prediction market platform in matters involving States Attorney General offices
  • Represented DraftKings regarding Massachusetts Attorneys General Office’s first-in-the-nation regulations around fantasy sports, ultimately avoiding an outright ban in Massachusetts and providing a roadmap forward for many other states
  • Represented a prominent media company in its return to television
  • Represented Netflix reality television stars in multiple matters, including sponsorships and endorsements, business, and nonprofit matters
  • Represented a world-renowned choreographer in negotiating a choreography services agreement for a multi-platinum recording artist’s world tour
  • Primary regional litigation counsel to an international broadcasting and entertainment company
  • Regularly advise clients on copyright licensing and public performance rights for music, film, television, and live sports content in commercial and public-facing venues, including negotiating blanket licenses, structuring content provider agreements, and counseling on compliance with performing rights organizations
  • Managed domestic and international trademark portfolios and handle trademark prosecution, global enforcement, litigation, and trademark oppositions and cancellation proceedings for several well-known media and publishing brands
  • Defended the world’s largest global electronic gaming tournament in connection with trademark infringement and dilution claims relating to the use of a mark in connection with promoting electronic sports competitions
  • Represented a former member of a legendary jazz quartet in copyright infringement and bootlegging litigation brought against a record company concerning sales of unauthorized recordings featuring the band member’s live musical performances
  • Represented a documentary filmmaker in copyright infringement dispute with former producer over ownership of her film footage
  • Defended one of the most famous “mixtape” music producers in connection with a trademark infringement and right of publicity litigation stemming from the sale of mixtapes alleged to contain samples of a television personality’s voice
